Work Permits (Employment Authorization)
A work permit, also called an Employment Authorization Document (EAD), allows certain immigrants to work legally in the United States.
Work permits are usually temporary but can often be renewed.
Who Qualifies
Many individuals may be eligible for a work permit, including:
- Asylum applicants and people granted asylum
- Refugees
- Individuals applying for a green card
- Certain visa holders such as F-1 students using OPT
- H-4 spouses of certain visa holders
- Temporary Protected Status (TPS) beneficiaries
- DACA recipients
- VAWA applicants
- U visa applicants and other humanitarian categories
The Application Process
Confirm eligibility based on immigration status
File Form I-765 (Application for Employment Authorization)
Attend a biometrics appointment
USCIS reviews the application
Receive the Employment Authorization Document if approved
Most work permits are valid for one to two years and must be renewed to continue working.
